Terms of Service

1. Who we are

“Company,” “we,” “our,” or “us” means Tinker Citadel LLC. “Services” means the CastHaven website (casthaven.com) and the other products and sites operated by Tinker Citadel LLC. “You” means the person using the Services.

2. Eligibility and accounts

This site is intended for adults aged 18 and older — you must be at least 18 to use the Services. CastHaven does not offer accounts today. When sign-in launches, you will be responsible for keeping your login secure and for activity under your account; we recommend strong, unique credentials.

3. Acceptable use

You agree not to:

• scrape, crawl, or bulk-download the site except as our robots rules allow;
• disrupt or overload the Services, probe for vulnerabilities, or bypass rate limits and access controls;
• submit false, abusive, infringing, or unlawful content through any form;
• resell, redistribute, or commercially exploit the Services without our written permission.

Abuse of any Company employee or officer — verbal, written, or otherwise, including threats — will result in immediate loss of access.

4. CastHaven is information, not advice

CastHaven aggregates public tournament results and generates data-driven analysis and editorial. It is a tool for understanding the competitive metagame — not professional advice and not a guarantee of any outcome. Figures, archetype labels, rankings, and articles may contain errors, gaps, or stale data, and some content is produced with automated and AI assistance. To the maximum extent permitted by law, we are not responsible for decisions you make in reliance on the Services. Verify anything that matters against the original sources we credit.

5. Affiliate links

Some “Rent” and “Buy” links are affiliate links (for example, ManaTraders and eBay). If you complete a purchase or rental through one, we may earn a commission at no extra cost to you. We only place these where they are genuinely useful and never let them dictate our analysis or editorial.

6. Intellectual property and fan content

Tinker Citadel LLC and its licensors own the Services themselves — the software, design, original written content, and branding. Using the Services grants you no ownership; you may not copy or reuse our code, design, or written content without our written permission.

CastHaven is unofficial Fan Content permitted under the Wizards of the Coast Fan Content Policy. It is not approved or endorsed by Wizards. Portions of the materials used are property of Wizards of the Coast. © Wizards of the Coast LLC. Card data and images are provided by Scryfall, with artist and copyright credits shown wherever card art appears. Tournament data is credited to its sources on each page.

If you believe content on CastHaven infringes your copyright, send a notice meeting the Digital Millennium Copyright Act requirements to casthaven@tinkercitadel.com.

7. Subscriptions and billing (when available)

CastHaven has no paid plans today. When a paid subscription that removes display ads launches, these terms will apply: a third-party payment processor will act as merchant of record and calculate any applicable sales tax or VAT at checkout; subscriptions renew automatically until canceled; and price changes will be announced at least 30 days in advance. Except where a refund is required by applicable law — including any statutory cancellation or “cooling-off” rights you may have — payments are non-refundable. 8. Changes to the Services

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We are not liable to you for any such change.

9. Disclaimers

You use the Services at your own risk. They are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. We make no guarantees about uptime.

10. Limitation of liability

To the maximum extent permitted by law, Tinker Citadel LLC is not liable to you or any third party for any indirect, incidental, special, or consequential damages, or for any damages arising from your use of or inability to use the Services, unauthorized access to your data, the actions of other users, or your reliance on any content.

11. Governing law and dispute resolution

These terms and any dispute are governed by the law of the State of New York, without regard to its conflict-of-laws rules.

Informal resolution first. Before starting arbitration, you and we agree to try to resolve the dispute informally for at least 30 days after written notice is sent to casthaven@tinkercitadel.com (we send notice to your account or contact email).

Binding individual arbitration. Except for the carve-outs below, disputes not resolved informally are settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Judgment on the award may be entered in any court with jurisdiction.

Carve-outs. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in New York state or federal court to protect intellectual property or confidential information.

Class-action waiver. You and Tinker Citadel LLC agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding.

30-day opt-out. You may opt out of this arbitration section by emailing casthaven@tinkercitadel.com within 30 days of first accepting these terms, stating your name and your request to opt out. Opting out affects only this section; the rest of the terms still apply, and disputes then resolve in the New York state and federal courts. Nothing here limits any mandatory consumer-protection rights you have where you live.
